How HRA exemption is calculated

House Rent Allowance exemption is governed by Section 10(13A) of the Income Tax Act, 1961, read with Rule 2A of the Income Tax Rules, 1962. It is available only under the old tax regime — the new regime removed it entirely.

The exemption is not simply the rent you pay, and it is not the HRA your employer gives you. It is the lowest of three separate amounts, calculated independently and then compared.

Exemption = lowest of these three

1. Actual HRA received from employer
2. Rent paid 10% of (Basic + DA)
3. 50% of (Basic + DA) if metro, else 40%

Because it is the lowest of three, whichever limb happens to be smallest becomes your binding constraint. Understanding which one binds in your case tells you whether paying more rent would help, or whether you have already hit a ceiling that rent cannot move.

Only four cities count as metro for this purpose: Mumbai, Delhi, Kolkata and Chennai. Bengaluru, Hyderabad, Pune and Gurugram are non-metro under Rule 2A regardless of what their rents look like — a long-standing source of frustration for taxpayers in those cities.

Worked example one: HRA received is the binding limb

An employee in Mumbai with basic plus DA of ₹6,00,000 a year receives ₹2,40,000 as HRA and pays ₹30,000 a month in rent, so ₹3,60,000 for the year.

The entire HRA is exempt. At a 30% slab with cess, that is worth ₹74,880 in tax saved. Note what this means practically: she is already extracting the full value of her HRA, so paying higher rent would not increase her exemption by a single rupee. The only way to claim more would be a larger HRA component in her salary structure.

Worked example two: rent minus 10% is the binding limb

Same basic of ₹6,00,000 and same ₹2,40,000 HRA, but this employee lives in Jaipur paying ₹10,000 a month, so ₹1,20,000 a year.

Only ₹60,000 is exempt; the remaining ₹1,80,000 of HRA is added to taxable salary. The 10% deduction is doing the damage here — half his rent is absorbed before the calculation even begins. This is the most common situation for people whose rent is modest relative to their basic salary.

Worked example three: the 50% ceiling binds

An employee in Delhi with basic plus DA of ₹8,00,000 receives ₹5,00,000 HRA and pays ₹50,000 a month, so ₹6,00,000 annually.

Here neither the rent nor the HRA is the constraint — the statutory 50% ceiling is. ₹1,00,000 of HRA becomes taxable no matter how much rent is paid. Once the third limb binds, only a higher basic salary raises the ceiling.

Documentation and the PAN requirement

Employers require rent receipts to allow the exemption while computing TDS. Where annual rent exceeds ₹1,00,000, the landlord's PAN must be reported. If the landlord has no PAN, a declaration in their name with their address is accepted in its place.

Rent paid to a parent is permissible — the law does not prohibit it — but the arrangement must be genuine. That means an actual rental agreement, rent actually transferred by bank, and the parent declaring the rental income on their own return. Assessing officers examine these arrangements, and a family member who receives rent but never declares it is the usual point of failure.

Claiming HRA and home loan interest together

This is permitted and more common than people expect. You can claim HRA on the house you rent and live in, while separately claiming interest under Section 24(b) on a property you own elsewhere — for instance a flat in your home town that is let out or lying vacant. What you cannot do is claim HRA for a house you own and occupy yourself. Where the owned property is in the same city and you claim to rent elsewhere, expect the arrangement to be questioned.

Section 80C: what actually fills the ₹1,50,000

The 80C ceiling is a single combined limit, not a limit per instrument. Most salaried employees have a large part of it already used before they invest anything voluntarily, because their EPF contribution counts.

On a basic of ₹6,00,000, EPF alone contributes ₹72,000, leaving ₹78,000 of headroom. Adding ₹50,000 of PPF and ₹15,000 of life insurance premium brings the total to ₹1,37,000 — only ₹13,000 short. Working out your existing EPF first prevents the common mistake of investing ₹1,50,000 on top of it and getting no deduction for the excess.

Section 80CCD(1B) sits outside the 80C limit

An additional ₹50,000 for NPS contributions is available over and above the ₹1,50,000 ceiling. This is the only straightforward way to deduct more than ₹1.5 lakh, and it is frequently overlooked.

What this calculator cannot account for

Outside the scope of this tool
  • Mid-year changes. If your rent, salary or city changes during the year, HRA exemption must be computed separately for each period and then added. This tool assumes stable figures for twelve months.
  • Section 80GG. If you pay rent but receive no HRA at all, relief comes under Section 80GG instead, capped at ₹60,000 a year with its own conditions.
  • Shared accommodation. Where rent is split with flatmates, only your own share is claimable and receipts should reflect that.
  • Perquisite accommodation. Employer-provided housing is valued under Rule 3 as a perquisite and is not an HRA situation at all.
  • 80C sub-limits. Some instruments carry their own caps — PPF at ₹1,50,000, insurance premium at 10% of sum assured — that operate inside the overall ceiling.
  • New regime. Neither HRA exemption nor 80C is available there. Both this tool's outputs assume you have opted into the old regime.

Common mistakes

Assuming the full rent is exempt. The 10% of basic deduction always reduces the second limb, and the other two limbs cap it further.
Treating Bengaluru, Hyderabad or Pune as metro. Only Mumbai, Delhi, Kolkata and Chennai qualify under Rule 2A. Everywhere else uses 40%, not 50%.
Using gross salary instead of basic plus DA. Every limb of the calculation runs on basic plus dearness allowance only.
Claiming HRA in the new regime. It does not exist there. Opting into the old regime is a prerequisite, not an afterthought.
Investing ₹1,50,000 in 80C without counting EPF. Your EPF contribution is already inside the limit. Anything beyond the ceiling earns no deduction at all.
Paying rent to a parent in cash with no paperwork. The arrangement is legal but must be real — agreement, bank transfer, and the parent declaring the income.
Forgetting the landlord's PAN above ₹1,00,000 rent. Employers will disallow the exemption at TDS stage without it.

मकान किराया भत्ता (HRA) की छूट आयकर अधिनियम, 1961 की धारा 10(13A) तथा आयकर नियमावली, 1962 के नियम 2A द्वारा शासित है। यह केवल पुरानी कर व्यवस्था में उपलब्ध है — नई व्यवस्था ने इसे पूरी तरह हटा दिया है।

छूट न तो आपके द्वारा चुकाया गया पूरा किराया है, न ही नियोक्ता से मिलने वाला HRA। यह तीन अलग-अलग राशियों में सबसे कम होती है, जिनकी गणना स्वतंत्र रूप से करके फिर तुलना की जाती है।

छूट = इन तीनों में सबसे कम

1. नियोक्ता से वास्तव में प्राप्त HRA
2. चुकाया गया किराया (मूल वेतन + DA) का 10%
3. महानगर में (मूल + DA) का 50%, अन्यथा 40%

चूँकि यह तीन में सबसे कम है, जो भी खंड सबसे छोटा निकलता है वही आपकी बाध्यकारी सीमा बन जाता है। यह समझना कि आपके मामले में कौन सा खंड बाध्यकारी है, बताता है कि अधिक किराया देने से लाभ होगा या आप पहले ही ऐसी सीमा पर हैं जिसे किराया नहीं बदल सकता।

यहाँ न किराया सीमा है, न HRA — वैधानिक 50% की सीमा बाध्यकारी है। कितना भी किराया दिया जाए, ₹1,00,000 HRA कर योग्य रहेगा। एक बार तीसरा खंड बाध्यकारी हो जाए, तो केवल ऊँचा मूल वेतन ही यह सीमा बढ़ा सकता है।

दस्तावेज़ और PAN की आवश्यकता

TDS गणना के समय छूट देने के लिए नियोक्ता किराया रसीदें माँगते हैं। जहाँ वार्षिक किराया ₹1,00,000 से अधिक हो, वहाँ मकान मालिक का PAN देना अनिवार्य है। यदि मकान मालिक के पास PAN न हो, तो उसके नाम और पते सहित घोषणा स्वीकार की जाती है।

माता-पिता को किराया देना अनुमत है — कानून इसे नहीं रोकता — पर व्यवस्था वास्तविक होनी चाहिए। इसका अर्थ है वास्तविक किराया अनुबंध, बैंक से किराए का वास्तविक हस्तांतरण, और माता-पिता द्वारा अपने रिटर्न में उस किराया आय की घोषणा। निर्धारण अधिकारी ऐसी व्यवस्थाओं की जाँच करते हैं, और किराया प्राप्त करके उसे घोषित न करने वाला परिजन ही आमतौर पर विफलता का कारण बनता है।

HRA और गृह ऋण ब्याज एक साथ लेना

यह अनुमत है और लोगों की अपेक्षा से अधिक सामान्य है। आप जिस मकान में किराए पर रहते हैं उस पर HRA ले सकते हैं, और साथ ही कहीं और अपनी संपत्ति पर धारा 24(b) के अंतर्गत ब्याज कटौती भी — जैसे गृह नगर में किराए पर दिया या खाली पड़ा फ्लैट। जो नहीं कर सकते वह है अपने स्वामित्व वाले और स्वयं रहने वाले मकान पर HRA का दावा। यदि स्वामित्व वाली संपत्ति उसी शहर में है और आप कहीं और किराए पर रहने का दावा करते हैं, तो प्रश्न उठने की अपेक्षा रखें।

धारा 80C: ₹1,50,000 वास्तव में किससे भरता है

  • नियोक्ता द्वारा दिया आवास। यह नियम 3 के अंतर्गत अनुलाभ के रूप में मूल्यांकित होता है और HRA की स्थिति है ही नहीं।
  • 80C की उप-सीमाएँ। कुछ साधनों की अपनी सीमाएँ हैं — PPF ₹1,50,000, बीमा प्रीमियम बीमा राशि का 10% — जो कुल सीमा के भीतर काम करती हैं।

आम गलतियाँ

यह मानना कि पूरा किराया कर-मुक्त है। मूल का 10% घटाने से दूसरा खंड हमेशा कम होता है, और शेष दो खंड उसे और सीमित करते हैं।

नई व्यवस्था में HRA का दावा करना। वहाँ यह है ही नहीं। पुरानी व्यवस्था चुनना पूर्व-शर्त है, बाद की बात नहीं।
EPF गिने बिना 80C में ₹1,50,000 निवेश करना। आपका EPF योगदान पहले से इसी सीमा में है। सीमा से आगे की राशि पर कोई कटौती नहीं मिलती।

What if I pay rent but do not receive HRA?

Relief is available under Section 80GG instead. It is capped at the lowest of Rs 5,000 a month, 25% of total income, or rent paid minus 10% of total income — so a maximum of Rs 60,000 a year. You must not own a residential property in the city where you work, and you file Form 10BA to claim it. Like HRA, this is old regime only.

केवल चार: मुंबई, दिल्ली, कोलकाता और चेन्नई। ये मूल वेतन के 50% वाले खंड के लिए पात्र हैं। बेंगलुरु, हैदराबाद, पुणे, गुरुग्राम और अहमदाबाद सहित शेष सभी शहर नियम 2A के अंतर्गत गैर-महानगर माने जाते हैं और वहाँ 40% लगता है, चाहे स्थानीय किराया कितना भी ऊँचा हो।

क्या मैं HRA और गृह ऋण ब्याज दोनों एक साथ ले सकता हूँ?

हाँ। आप जिस मकान में किराए पर रहते हैं उस पर HRA ले सकते हैं, और साथ ही कहीं और अपनी संपत्ति पर धारा 24(b) के अंतर्गत गृह ऋण ब्याज भी — जैसे गृह नगर में किराए पर दिया या खाली फ्लैट। जो नहीं कर सकते वह है अपने स्वामित्व वाले और स्वयं रहने वाले मकान पर HRA का दावा। यदि वह संपत्ति उसी शहर में है और आप कहीं और किराए पर रहने का दावा करते हैं, तो प्रश्न उठ सकते हैं।

क्या मैं माता-पिता को किराया देकर HRA ले सकता हूँ?

हाँ, कानून इसकी अनुमति देता है, पर व्यवस्था वास्तविक होनी चाहिए। आपको वास्तविक किराया अनुबंध चाहिए, किराया नकद के बजाय बैंक से भेजा जाना चाहिए, और आपके माता-पिता को अपने रिटर्न में वह किराया आय घोषित करनी होगी। निर्धारण अधिकारी ऐसी व्यवस्थाओं की जाँच करते हैं, और आमतौर पर विफलता तब होती है जब किराया लेने वाला परिजन उसे घोषित नहीं करता।

HRA का दावा करने के लिए कौन से दस्तावेज़ चाहिए?

जिस अवधि का दावा है उसकी किराया रसीदें, और नियोक्ता माँगे तो किराया अनुबंध। जहाँ वार्षिक किराया ₹1,00,000 से अधिक हो, वहाँ मकान मालिक का PAN देना होगा। यदि मकान मालिक के पास PAN न हो, तो उसके नाम और पते सहित घोषणा स्वीकार की जाती है। PAN के बिना नियोक्ता TDS चरण पर छूट अस्वीकार कर देंगे।

धारा 80C की ₹1,50,000 सीमा में क्या-क्या आता है?

यह एक संयुक्त सीमा है जिसमें कर्मचारी EPF योगदान, PPF, ELSS म्यूचुअल फंड, जीवन बीमा प्रीमियम, गृह ऋण मूलधन, दो बच्चों तक की ट्यूशन फीस, सुकन्या समृद्धि, NSC और पाँच वर्षीय कर-बचत सावधि जमा शामिल हैं। ₹6,00,000 मूल वेतन पर अकेला EPF योगदान स्वैच्छिक निवेश से पहले ही ₹72,000 सीमा भर देता है।

NPS से कितना अतिरिक्त टैक्स बचाया जा सकता है?

धारा 80CCD(1B) NPS योगदान के लिए धारा 80C की ₹1,50,000 सीमा से ऊपर अतिरिक्त ₹50,000 की कटौती देती है। वेतनभोगी करदाता के लिए ₹1.5 लाख से अधिक कटौती लेने का यही एकमात्र सीधा तरीका है, और इसे अक्सर अनदेखा किया जाता है। धारा 80CCD(2) के अंतर्गत नियोक्ता का NPS योगदान इससे अलग है और दोनों कर व्यवस्थाओं में उपलब्ध रहता है।

यदि मैं किराया देता हूँ पर HRA नहीं मिलता तो क्या होगा?

उस स्थिति में राहत धारा 80GG के अंतर्गत मिलती है। यह तीन में सबसे कम तक सीमित है: ₹5,000 मासिक, कुल आय का 25%, या चुकाया गया किराया घटा कुल आय का 10% — अर्थात अधिकतम ₹60,000 वार्षिक। जिस शहर में आप काम करते हैं वहाँ आपके नाम आवासीय संपत्ति नहीं होनी चाहिए, और दावे के लिए फॉर्म 10BA भरना होता है। HRA की तरह यह भी केवल पुरानी व्यवस्था में है।
