How income tax is calculated in India

Indian income tax is charged on a slab basis, which means different portions of your income are taxed at different rates. A common misunderstanding is that crossing into a higher slab taxes your entire income at that rate. It does not. Only the amount falling inside each band is taxed at that band's rate.

Since the new regime became the default, most salaried taxpayers face a single practical question each year: stay with the new regime's lower rates, or opt into the old one and claim deductions. The answer turns entirely on how large your deductions actually are, and for most people they are smaller than they assume.

The old regime's problem is structural: it reaches the 30% rate at ₹10 lakh, whereas the new regime does not reach it until ₹24 lakh. That gap is very hard to close with deductions alone.

Worked example: ₹18,00,000 salary, both regimes

Consider a salaried employee earning ₹18 lakh gross, renting in a metro, with a full ₹1.5 lakh in 80C, ₹25,000 of health insurance, ₹50,000 in NPS under 80CCD(1B), and an HRA exemption of ₹2.4 lakh. These are close to the maximum most salaried people can realistically claim.

The new regime wins by ₹55,120 despite the old regime removing ₹5,15,000 more from taxable income. At this salary level you would need roughly ₹6,75,000 of total deductions before the old regime breaks even — which in practice means a home loan on top of everything else.

The Section 87A rebate and marginal relief

The rebate under Section 87A is what makes income up to ₹12 lakh effectively tax-free in the new regime. It is a rebate, not an exemption: tax is computed normally on the slabs, then the rebate cancels it out entirely if taxable income does not exceed ₹12,00,000.

Cross that line by even a rupee and the rebate disappears completely. Without a safeguard, someone earning ₹12,00,001 would owe ₹60,000 more than someone earning ₹12,00,000 — a cliff edge produced by one rupee of extra income.

How marginal relief prevents the cliff

Marginal relief caps your tax at the amount by which your income exceeds ₹12,00,000. If taxable income is ₹12,10,000, the excess is ₹10,000, so tax before cess is limited to ₹10,000 rather than the ₹61,500 the slabs would otherwise produce.

Relief tapers to nothing at roughly ₹12,75,000, after which normal slab tax applies. Between ₹12 lakh and that point, every extra rupee of income is effectively taxed at 100% until the relief runs out.

Surcharge on higher incomes

Above ₹50 lakh, a surcharge applies on the tax amount itself, before cess.

The new regime caps surcharge at 25%, which brings the top effective rate to about 39% against roughly 42.7% under the old regime. For very high earners this alone usually settles the regime choice.

The rules this calculator applies

Standard deduction

₹75,000 under the new regime, ₹50,000 under the old, available to salaried taxpayers and pensioners without any proof or investment.

Health and education cess

4% charged on tax plus surcharge, not on income. It applies under both regimes and no deduction reduces it.

Section 80C

₹1,50,000 ceiling covering EPF, PPF, ELSS, life insurance premium, principal repayment on a home loan, tuition fees for two children, NSC and five-year tax-saving deposits. Old regime only.

Section 80CCD(1B)

An additional ₹50,000 for NPS contributions, over and above the 80C ceiling. Old regime only. Employer NPS contributions under 80CCD(2) remain available in both regimes.

Section 80D

Health insurance premium up to ₹25,000 for yourself and family, plus a further ₹50,000 for senior citizen parents. Old regime only.

What this calculator cannot account for

Outside the scope of this tool
  • Capital gains. Equity, property and debt gains are taxed under separate provisions at their own rates, not at slab rates.
  • Business or professional income. Presumptive taxation under 44AD and 44ADA works differently from salary.
  • House property loss set-off. Limited to ₹2 lakh a year against other income, with the balance carried forward for eight years.
  • Advance tax and interest. Sections 234A, 234B and 234C interest for shortfalls or late payment are not modelled.
  • Perquisites. Company accommodation, cars and stock options are valued under Rule 3 and added to salary income.
  • Clubbing and set-off rules. Spouse or minor income clubbed under Section 64 is not considered.

Common mistakes

Thinking a higher slab taxes all your income. Slabs are marginal. Reaching the 30% band means only the income above that threshold is taxed at 30%.
Assuming the old regime is better because it has more deductions. More deductions on higher rates frequently loses to fewer deductions on lower ones. Calculate both before deciding.
Treating ₹12 lakh as an exemption limit. It is a rebate threshold in the new regime. Above it, tax applies from ₹4 lakh upward, softened only by marginal relief.
Forgetting the old regime must be actively chosen. The new regime applies by default. Failing to declare means you are taxed under it whether or not that suits you.
Investing purely to save tax. Spending ₹1.5 lakh to save ₹45,000 makes sense only if you wanted the investment anyway. In the new regime the deduction does not exist at all.
Ignoring cess when comparing. The 4% applies to the tax figure, so a larger tax bill carries a proportionately larger cess.

पुरानी व्यवस्था की समस्या संरचनात्मक है: वह ₹10 लाख पर ही 30% दर तक पहुँच जाती है, जबकि नई व्यवस्था ₹24 लाख तक वहाँ नहीं पहुँचती। इस अंतर को केवल कटौतियों से पाटना बहुत कठिन है।

पुरानी व्यवस्था कर योग्य आय से ₹5,15,000 अधिक घटाने के बावजूद नई व्यवस्था ₹55,120 से जीतती है। इस वेतन स्तर पर पुरानी व्यवस्था के बराबरी पर आने के लिए लगभग ₹6,75,000 की कुल कटौतियाँ चाहिए — जिसका व्यावहारिक अर्थ है इन सबके ऊपर एक गृह ऋण भी।

धारा 87A छूट और सीमांत राहत

धारा 87A की छूट ही नई व्यवस्था में ₹12 लाख तक की आय को प्रभावी रूप से कर-मुक्त बनाती है। यह छूट (rebate) है, अपवर्जन नहीं: कर पहले स्लैब पर सामान्य रूप से गणित होता है, फिर यदि कर योग्य आय ₹12,00,000 से अधिक नहीं है तो यह छूट उसे पूरी तरह समाप्त कर देती है।

यह सीमा एक रुपये से भी पार होते ही छूट पूरी तरह चली जाती है। बिना किसी सुरक्षा के ₹12,00,001 कमाने वाले को ₹12,00,000 कमाने वाले से ₹60,000 अधिक कर देना पड़ता — एक रुपये की अतिरिक्त आय से बना यह विषम पड़ाव।

सीमांत राहत इस पड़ाव को कैसे रोकती है

सीमांत राहत आपके कर को उस राशि तक सीमित कर देती है जितनी आपकी आय ₹12,00,000 से अधिक है। यदि कर योग्य आय ₹12,10,000 है, तो अधिकता ₹10,000 है, इसलिए उपकर से पहले कर ₹10,000 तक सीमित रहेगा, न कि स्लैब से बनने वाला ₹61,500।

नई व्यवस्था अधिभार को 25% पर सीमित रखती है, जिससे उच्चतम प्रभावी दर लगभग 39% रहती है, पुरानी व्यवस्था के लगभग 42.7% के मुकाबले। बहुत अधिक आय वालों के लिए अक्सर यही अकेला कारण व्यवस्था तय कर देता है।

धारा 80CCD(1B)

  • अग्रिम कर और ब्याज। धारा 234A, 234B और 234C का ब्याज इस टूल में शामिल नहीं है।
  • अनुलाभ। कंपनी आवास, गाड़ी और स्टॉक विकल्प नियम 3 के अंतर्गत मूल्यांकित होकर वेतन आय में जुड़ते हैं।
  • क्लबिंग नियम। धारा 64 के अंतर्गत जीवनसाथी या अवयस्क की आय का समावेश यहाँ नहीं माना गया है।

आम गलतियाँ

यह समझना कि ऊँचा स्लैब पूरी आय पर लगता है। स्लैब सीमांत होते हैं। 30% खंड में पहुँचने का अर्थ है कि केवल उस सीमा से ऊपर की आय पर 30% लगेगा।
यह मानना कि अधिक कटौतियों के कारण पुरानी व्यवस्था बेहतर है। ऊँची दरों पर अधिक कटौतियाँ अक्सर कम दरों पर कम कटौतियों से हार जाती हैं। निर्णय से पहले दोनों की गणना करें।
₹12 लाख को छूट सीमा मान लेना। यह नई व्यवस्था में rebate की सीमा है। उससे ऊपर कर ₹4 लाख से ही लगना शुरू होता है, जिसे केवल सीमांत राहत नरम करती है।
यह भूलना कि पुरानी व्यवस्था सक्रिय रूप से चुननी पड़ती है। नई व्यवस्था स्वतः लागू होती है। घोषणा न करने पर आप उसी में कर योग्य रहेंगे, चाहे वह आपके लिए उपयुक्त हो या नहीं।
केवल कर बचाने के लिए निवेश करना। ₹45,000 बचाने के लिए ₹1.5 लाख खर्च करना तभी उचित है जब वह निवेश आप वैसे भी चाहते थे। नई व्यवस्था में तो यह कटौती है ही नहीं।
तुलना करते समय उपकर भूल जाना। 4% कर की राशि पर लगता है, इसलिए बड़ा कर बिल आनुपातिक रूप से बड़ा उपकर लाता है।

It depends entirely on your deductions. The new regime has lower rates, a Rs 75,000 standard deduction and reaches 30% only above Rs 24 lakh. The old regime allows HRA, 80C, 80D and home loan interest but hits 30% at Rs 10 lakh. At Rs 18 lakh salary with maximum realistic deductions of Rs 5.15 lakh, the new regime still saves Rs 55,120. Breakeven needs roughly Rs 6.75 lakh of deductions, which usually means a home loan on top of everything else.

How does the Section 87A rebate work in FY 2026-27?

Under the new regime, taxable income up to Rs 12,00,000 attracts no tax because the Section 87A rebate cancels the computed tax entirely. It is a rebate, not an exemption — tax is calculated normally on the slabs first, then wiped out. Under the old regime the rebate threshold is Rs 5,00,000. Crossing the threshold removes the rebate completely, which is why marginal relief exists.

What is marginal relief and when does it apply?

Marginal relief prevents a tax cliff just above the Rs 12,00,000 rebate threshold in the new regime. Without it, earning one rupee more than Rs 12 lakh would cost Rs 60,000 in tax. Relief caps your tax at the amount by which income exceeds Rs 12 lakh. At Rs 12,10,000 taxable income the slab tax is Rs 61,500 but relief of Rs 51,500 limits it to Rs 10,000 plus cess. Relief tapers to nothing at around Rs 12,75,000.

What is the Section 80C deduction limit for FY 2026-27?

Rs 1,50,000, available only under the old regime. It covers employee EPF contribution, PPF, ELSS mutual funds, life insurance premium, principal repayment on a home loan, tuition fees for up to two children, NSC and five-year tax-saving fixed deposits. An additional Rs 50,000 for NPS is available separately under Section 80CCD(1B).

Does a higher tax slab mean my entire income is taxed at that rate?

No. Indian income tax slabs are marginal. If your taxable income is Rs 14,00,000 under the new regime, the first Rs 4,00,000 is taxed at nil, the next Rs 4,00,000 at 5%, the next Rs 4,00,000 at 10%, and only the remaining Rs 2,00,000 at 15%. Reaching a higher slab never increases the rate on income already taxed in lower bands.

What surcharge applies on income above Rs 50 lakh?

Surcharge is charged on the tax amount, before cess. It is 10% for income between Rs 50 lakh and Rs 1 crore, 15% between Rs 1 crore and Rs 2 crore, and 25% between Rs 2 crore and Rs 5 crore under both regimes. Above Rs 5 crore the new regime caps surcharge at 25% while the old regime charges 37%, giving top effective rates of roughly 39% and 42.7% respectively.

Do I have to choose the old regime every year?

Yes. The new regime is the default. If you want the old regime you must declare it to your employer at the start of each financial year, and salaried taxpayers without business income can switch between regimes annually when filing. Failing to declare means you are taxed under the new regime whether or not it suits you.

नई व्यवस्था में ₹12,00,000 तक की कर योग्य आय पर कोई कर नहीं लगता क्योंकि धारा 87A की छूट गणित किए गए कर को पूरी तरह समाप्त कर देती है। यह rebate है, अपवर्जन नहीं — कर पहले स्लैब पर सामान्य रूप से गणित होता है, फिर समाप्त हो जाता है। पुरानी व्यवस्था में यह सीमा ₹5,00,000 है। सीमा पार करते ही छूट पूरी तरह चली जाती है, इसीलिए सीमांत राहत का प्रावधान है।

सीमांत राहत क्या है और कब लागू होती है?

सीमांत राहत नई व्यवस्था में ₹12,00,000 की छूट सीमा के ठीक ऊपर बनने वाले विषम पड़ाव को रोकती है। इसके बिना ₹12 लाख से एक रुपया अधिक कमाने पर ₹60,000 कर देना पड़ता। राहत आपके कर को उस राशि तक सीमित कर देती है जितनी आय ₹12 लाख से अधिक है। ₹12,10,000 कर योग्य आय पर स्लैब कर ₹61,500 बनता है, पर ₹51,500 की राहत उसे ₹10,000 और उपकर तक सीमित कर देती है। राहत लगभग ₹12,75,000 पर समाप्त हो जाती है।

FY 2026-27 में धारा 80C की कटौती सीमा कितनी है?

₹1,50,000, जो केवल पुरानी व्यवस्था में उपलब्ध है। इसमें कर्मचारी EPF योगदान, PPF, ELSS म्यूचुअल फंड, जीवन बीमा प्रीमियम, गृह ऋण मूलधन, दो बच्चों तक की ट्यूशन फीस, NSC और पाँच वर्षीय कर-बचत सावधि जमा शामिल हैं। NPS के लिए अतिरिक्त ₹50,000 धारा 80CCD(1B) के अंतर्गत अलग से उपलब्ध है।

क्या ऊँचे स्लैब में जाने पर पूरी आय उसी दर से कर योग्य हो जाती है?

नहीं। भारतीय आयकर स्लैब सीमांत होते हैं। यदि नई व्यवस्था में आपकी कर योग्य आय ₹14,00,000 है, तो पहले ₹4,00,000 पर शून्य, अगले ₹4,00,000 पर 5%, अगले ₹4,00,000 पर 10%, और शेष ₹2,00,000 पर ही 15% लगेगा। ऊँचे स्लैब में पहुँचने से नीचे के खंडों में पहले से कर योग्य आय की दर कभी नहीं बढ़ती।

₹50 लाख से ऊपर की आय पर कितना अधिभार लगता है?

अधिभार कर की राशि पर लगता है, उपकर से पहले। ₹50 लाख से ₹1 करोड़ के बीच 10%, ₹1 करोड़ से ₹2 करोड़ के बीच 15%, और ₹2 करोड़ से ₹5 करोड़ के बीच 25% — दोनों व्यवस्थाओं में। ₹5 करोड़ से ऊपर नई व्यवस्था अधिभार को 25% पर सीमित रखती है जबकि पुरानी 37% लेती है, जिससे उच्चतम प्रभावी दरें क्रमशः लगभग 39% और 42.7% बनती हैं।

क्या पुरानी व्यवस्था हर साल चुननी पड़ती है?

हाँ। नई व्यवस्था डिफ़ॉल्ट है। पुरानी चाहिए तो हर वित्त वर्ष के आरंभ में नियोक्ता को घोषणा देनी होगी, और व्यावसायिक आय रहित वेतनभोगी करदाता रिटर्न भरते समय हर वर्ष व्यवस्था बदल सकते हैं। घोषणा न करने पर आप नई व्यवस्था में ही कर योग्य रहेंगे, चाहे वह आपके लिए उपयुक्त हो या नहीं।
